• America First Legal Sends Warning Letter To Lamont, Argues CT Is Breaking Federal Law On Immigration

    America First Legal ("AFL") sent a letter to Connecticut Governor Ned Lamont on December 23, 2024, to put him on notice and warn him about the potential legal consequences for "interfering with or impeding federal immigration law enforcement and for concealing, harboring, or shielding illegal aliens."

    The letter starts off asserting that, "Federal law is clear: aliens unlawfully present in the United States are subject to removal from the country, and it is a crime to conceal, harbor, or shield them. It is also a crime to prevent federal officials from enforcing immigration law."

    This is a good reminder to share with CT Attorney General William Tong, who has been touring the state since Trump won, promising to protect illegals under Connecticut's Trust Act, and refusing to cooperate with ICE.

    AFL reminded Lamont that under the Supremacy Clause of the U.S. Constitution, federal immigration law is the law of the land, and it supersedes any state or local laws to the contrary, even Connecticut's Trust Act. Furthermore, the federal government imposes serious consequences for obstructing the execution of federal immigration law.

    "We have identified your jurisdiction as a sanctuary jurisdiction that is violating federal law," warns AFL. "Such lawlessness subjects you and your subordinates to significant risk of criminal and civil liability."

    The AFL letter goes on to highlight the 647,572 illegal aliens in the U.S. who are either convicted criminals or illegals with final orders of removal who had criminal charges pending against them.

    Remember when local officials at the Hartford Correctional Center ignored an ICE immigration detainer and released an illegal from Honduras who had been charged with sexual assault of a minor? Did you realize it took ICE another two months to find him?

    AFL detailed five specific warnings to Lamont:

    1. The Federal Government has authority over immigration and aliens.
    2. Federal law preempts any State or local law prohibiting or restricting a State or local official from communicating with DHS about an individual’s immigration status.
    3. Concealing, harboring, or shielding aliens is a federal crime.
    4. Your jurisdiction’s sanctuary policies could expose you and your subordinates to criminal liability for conspiracy to commit a federal offense and conspiracy to impede a federal officer.
    5. Your jurisdiction’s sanctuary policies could expose you and the other individual officials and employees involved to potential personal financial liability to private plaintiffs.

    "Your jurisdiction’s sanctuary laws or policies therefore make a mockery of American democracy and demonstrate a shocking disrespect for the rule of law," charges AFL. "For these reasons alone, you should abandon them."

    "But no matter your views on our Union, the fact of the matter is that you and the other officials who support or enforce sanctuary laws, policies, and regulations have a very personal stake in the matter – you each could face criminal prosecution and civil liability for your illegal acts," concludes AFL before urging Lamont "to do the right thing, protect your citizens, and comply with federal law."
