The U.S. Department of Education announced Monday its official repeal of a Biden administration Title IX rule that allowed sexual orientation and gender identity to be included in classifications that were illegally protected in school programs funded by the department.
“Today’s rulemaking clears the Biden Administration’s illegal rewrite of Title IX from the Code of Federal Regulations and restores the commonsense language promulgated in the first Trump Administration, which we have been enforcing since the first days of the Administration,” said U.S. Secretary of Education Linda McMahon in a press statement.
“Thanks to today’s action, the published Title IX regulations faithfully reflects court orders and Congressional intent—reducing confusion for parents, students, and educational institutions,” McMahon added. “We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls.”
The department notes that the Biden-era rules were deemed “illegal” after being “enjoined by eight different courts and later vacated by two separate courts.”
“After years of legal challenges to the Biden Administration’s rule, federal courts dismissed all remaining litigation concerning the Biden-era regulations last month,” the education department explained. “This cleared the way for the Trump Administration to issue today’s final regulation restoring the previous regulatory text.”
While Title IX of the Education Amendments of 1972 prohibits education programs that receive federal funding from discriminating on the basis of sex, the Biden administration caved to LGBT activists by permitting the category of “sex” to include male students identifying as female having a right to use girls’ and women’s bathrooms and locker rooms. Additionally, the Biden administration allowed boys and men claiming to identify as female to compete in girls’ and women’s competitive sports programs.
“The Biden Administration’s Office for Civil Rights (OCR) pushed schools across the country to illegally allow males to intrude into women’s sports and intimate facilities, and it investigated school staff for using incorrect pronouns or failing to ask students to declare a preferred gender,” the Trump education department observes.
By returning to the enforcement of “biological reality,” the Trump administration states it has “taken historic action to reverse the Biden Administration’s immeasurable harm to women and girls by restoring Title IX to its original meaning and intent, protecting the women and girls.”
LGBT activist organizations immediately denounced the Trump administration’s protection of biological sex through the repeal of the Biden-era regulations.
“The Trump administration is erasing protections for LGBTQ+ kids and survivors of sexual assault in school settings without an opportunity for public comment,” wrote the organization that calls itself the Human Rights Campaign (HRC). “Trump’s Department of Education has abandoned its duty to protect students from sex discrimination and sexual violence in schools.”
Many X users, however, condemned HRC’s claims, including Colorado Principled Physicians, who quickly responded by asserting HRC “is the fascist enforcer arm of the trans industry, using underhand methods to coerce both public and private employees as well as school children to fall in line.”
“Title IX exists to protect women and girls, sorry,” the doctors say. “People should understand what HRC actually does.”
Left-wing politicians who have embraced transgender ideology complained about the repeal of the Biden rules.
“The Department of Education just rolled back Title IX protections for LGBTQ+ students,” announced Illinois Gov. JB Pritzker (D). “Trump is once again attacking the civil rights protections that help make our country great. Illinois will remain a safe state for ALL students to pursue their dreams.”
U.S. Rep. Pramila Jayapal (D-WA) also decided to interpret the Trump administration’s move as telling “LGBTQ students” their “civil rights don’t count.”
“This is part of a wave of right-wing groups targeting children around the country and stripping rights away from millions,” Jayapal wrote. “And they want Washington state to follow their lead in November.”
But Moms for Liberty wrote: “Parents were right, girls were right, and Moms for Liberty will keep standing with them until every girl in America can compete and learn in safety and fairness.”
