Legislators in Hartford are pushing for changes to the Connecticut state constitution that would guarantee abortion without limits and add gender identity as a constitutionally-protected class.

The proposed legislation is Senate Joint Resolution 35, A Resolution Proposing A State Constitutional Amendment Concerning Discrimination On The Basis Of Sex Under The Equal Protection Clause.

The legislation would redefine "sex" in the Connecticut state constitution by adding the following language:

As used in this section, discrimination in the exercise or enjoyment of civil or political rights because of sex includes, but is not limited to, discrimination, in intent or effect, based on pregnancy, including preventing, initiating, continuing or terminating a pregnancy; sexual orientation; gender identity and expression; and related health care.

Adding abortion to the equal protection cause of the state constitution would make it nearly impossible to put legal limits on abortion in the state, potentially resulting in abortion without any limits throughout the full nine months of pregnancy.

If you think that no one would be crazy enough to advocate for aborting a full term, healthy baby because it sounds too much like murder, think again!

The progressive activist group Reproductive Equity Now seems to be advocating for exactly that -- "expanding access to abortion care throughout pregnancy" -- because they don't want to have any "arbitrary restrictions" that prevent women from aborting viable babies, apparently even at nine months.

The other part of SJ 35, adding "gender identity and expression" under the equal protection clause, would mean that anyone who does not accept a person's stated "gender identity" would be viewed as "discriminating" and potentially subject to both criminal and civil charges. It would mean biological boys could play on girl's teams and enter girl's private spaces, and concerned parents wouldn't have a leg to stand on.

This proposed change appears to directly oppose President Trump's Executive Order, Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.

The Executive Order says that it is "wrong" to deny the biological reality of sex, and that doing so "fundamentally attacks women by depriving them of their dignity, safety and well-being. The erasure of sex in language and policy has a corrosive impact not just on women but on the validity of the entire American system. Basing Federal policy on truth is critical to scientific inquiry, public safety, morale, and trust in government itself."

The Order says that "invalidating" the biological category of woman "improperly transforms laws and policies designed to protect sex-based opportunities into laws and policies that undermine them, replacing longstanding, cherished legal rights and values with an identity-based, inchoate social concept."

Additionally, the US Attorney General has been directed to issue guidance to ensure the freedom to express the binary nature of sex and the right to single-sex spaces in workplaces and federally funded entities covered by the Civil Rights Act of 1964.

Trump is further expected to sign an Executive Order this afternoon protecting women in sports.

But don’t expect Democrats to worry about passing legislation that violates a Presidential Executive Order... especially considering they already passed the TRUST Act even though it appears to be a direct violation of federal immigration law!

There is a public hearing scheduled on this resolution, S.J. 35, on Friday, Feb 7th at 12:00pm in Room 2B of the Legislative Office Building in Hartford. Here is the meeting agenda.
