Defending Education (DE) filed a civil rights complaint with the U.S. Department of Education against Yale University for alleged discrimination on the basis of sex in programs or activities that receive federal financial assistance in violation of Title IX of the Education Amendments of 1972.
"Yale University is one of the United States’ most prestigious educational institutions. It is one of nine American colleges that pre-existed the Declaration of Independence," wrote Defending Ed. "But its rich history only makes Yale’s apparent Title IX violations all the more tragic. Yale has conflated sex discrimination with gender identity discrimination, and among others, maintains a bathroom policy that denies the reality of biological sex. The storied institution seems content to follow its fellow progressive ivies down the path to sex denialism and trade federal law for political pandering to a certain subset of students."
According to the complaint, "Yale’s Title IX Office states that its mission is “to both prevent and respond to sex- and gender-based discrimination.” Gender discrimination is not the same as sex discrimination under Title IX, and the Supreme Court has never held otherwise. But that has not stopped Yale from violating its students’ Title IX rights in its pursuit of ideological goals."
"Yale’s Title IX office apparently (and wrongly) believes that Title IX applies to discrimination on the basis of both sex and gender," wrote DE in the complaint.
"Yale’s bathroom policies likely violate Title IX because they provide male and gender-neutral bathrooms on some coed undergraduate dormitory floors without also providing female bathrooms on the same dormitory floors," the complaint continued. "This means that some coed dormitory floors have male and gender-neutral bathrooms, but not female bathrooms."
"Yale’s bathroom policy appears to violate Title IX," concluded DE.
It requested that the Department of Education's Office of Civil Rights promptly investigate all the allegations in the complaint, remedy unlawful policies and practices, and order appropriate relief.
DE brought the complaint as an interested third-party organization with members who are parents and students throughout the country. DE and its members oppose policies that discriminate between students on the basis of sex in America’s K-12 schools and institutions of higher education. Title IX prohibits discrimination based on sex in any education program or activity receiving federal financial assistance. This includes female students’ rights to sex-segregated intimate spaces.
