Yesterday the United States filed a federal lawsuit against Connecticut for providing in-state tuition and financial aid to people living here illegally. The statute at issue is thirty years old. Courts have already used it to strike down similar policies in five other states.
Connecticut’s Attorney General responded with this: “Note to Trump: stay out of Connecticut.”
That is not a legal defense. That is a bumper sticker.
State sovereignty is a shield against federal commandeering. It is not a license to defy an Act of Congress. The Supremacy Clause is in Article VI of the Constitution. It contains no Connecticut exception, and the Attorney General knows it.
The hypocrisy is hard to miss. This same office has spent years suing the federal government, invoking federal law and federal courts whenever it was politically useful. Federal law does not run in only one direction.
And here is the real unfairness: a family from Ohio, or a legal immigrant who followed every rule, pays the full out-of-state rate at UConn. Meanwhile Connecticut offers the discounted in-state rate to someone here illegally. That is not compassion. It is a state telling its own citizens and lawful residents to go pound sand.
Connecticut deserves an Attorney General who answers a federal complaint with a serious legal argument, not playground rhetoric. Nobody is above the law — not the President, not the Governor, and not the Attorney General of Connecticut.
