The Democratic Party’s surge to envelop itself in the dark business of protecting abortionists and the transgender medical industry has landed in New Jersey.
Gov. Mikie Sherrill (D) on Thursday signed a bill into law that could even subject pro-lifers who peacefully pray outside abortion clinics to possible criminal penalties.
S2260 states it “secures protections for patients and providers accessing and providing reproductive health care services” and “establishes right of residents to reproductive health care activity that is restricted in other states.”
The text of the measure specifically states a person is “guilty of interference with reproductive health care services if the person purposely or knowingly”:
… inflicts or attempts to inflict bodily injury on another person, with purpose to unlawfully restrict another’s access to or receipt or provision of reproductive health care services or to intimidate the person from becoming or remaining a patient, provider, volunteer, or assistant of reproductive health care services, if the conduct would cause a reasonable person to be intimidated;
The new law expands legal protections for abortionists and blocks attempts by states that protect the lives of unborn babies from filing criminal or civil lawsuits against New Jersey.
Pro-life activists, however, assert the law is vague, for example, in its characterization of what might be construed as causing an experience of “intimidation” by patients or workers of the clinic.
New Jersey Right to Life (NJRTL) “strongly condemns” Sherrill’s decision to sign the bill.
“Governor Sherrill just signed a blank check for the abortion industry and a death warrant for countless unborn children with beating hearts, and she did it despite thousands of emails from New Jersey residents urging her to veto this bill,” said NJRTL Executive Director Marie Tasy. “S2260 does not protect women. It protects the people who end the lives of living human children already growing in the womb. New Jersey should be a sanctuary for mothers and babies, not a legal fortress for those who profit from abortion.”
Tasy added that the measure “also creates a new crime of ‘interference with reproductive health care services.’”
“Because terms such as ‘threat,’ ‘intimidate,’ and ‘coerce’ are inherently subjective and rest on individual feelings, this language poses a serious danger to free speech,” she said. “Peaceful sidewalk counseling, prayer, holding signs, or simply offering help and alternatives outside a facility can easily be labeled ‘intimidation’ by someone who claims to feel threatened, leaving pro-life advocates open to criminal charges that are difficult to disprove and chilling constitutionally protected expression.”
Live Action President Lila Rose posted to social media that the New Jersey law is “a violation of the First Amendment rights of pro-life Americans.”
“No person should be punished for praying for the unborn,” she said.
Rose herself has recently refused the demands of attorneys representing 13 abortion advocates who claim her organization has defamed their abortions using words such as “killing.”
According to Fox News, the Thomas More Society is representing Live Action and argues that the pro-life group’s coverage of abortion amounts to speech that is protected by the First Amendment.
Peter Breen, executive vice president and head of litigation at Thomas More Society, said the abortion advocates’ claim is that “somehow, by using the word kill or calling abortion killing, that you have a problem that you can create that could then be remedied in court.”
“The issue is every single final court decision to deal with this has previously said that’s not defamatory,” Breen noted. “It’s not legally wrong to call abortion killing.”
For Tasy, her state’s new law is a “deliberate act of defiance against the most basic human right — the right to life of every child in the womb with a beating heart.”
“Governor Sherrill and her allies have chosen to put the full power of state government behind abortion while building walls to keep accountability out and they are now creating vague new criminal penalties that can be used to silence those who object to these radical policies,” she asserted. “That is not compassion. That is blatant extremism. Women deserve meaningful support and genuine alternatives, not a state government focused on expanding protections for abortion.”
