UPDATE: Tong's Victory Lap Short-Lived, Trump's Tariffs To Remain In Effect For Now

Today the U.S. Court of Appeals for the Federal Circuit temporarily stayed the decision issued Wednesday by the United States Court of International Trade ruling that the Trump administration’s tariffs issued under the International Emergency Economic Powers Act (IEEPA) were invalid and could not be implemented.

The Trump Admin had argued that "the political branches, not courts, make foreign policy and chart economic policy" in its filing with the Court of Appeals.

The Court of International Trade had ruled in favor of Attorney General Tong and a coalition of 11 other attorneys general who sued the Trump administration in April for allegedly violating the law by imposing worldwide tariffs under IEEPA.

“We expected this appeal, and we are prepared for this appeal. This temporary stay does not change the underlying facts—Trump concocted a fake emergency to launch a lawless and pointless trade war.  His tariffs have inflicted needless chaos and economic uncertainty. We remain highly confident in our case, and we are in this fight for as long as it takes to protect Connecticut families and small businesses,” said Attorney General Tong.

Karoline Leavitt said at a press briefing today, "America cannot function if President Trump, or any other president, for that matter, has their sensitive diplomatic or trade negotiations railroaded by activist judges."

Meanwhile, President Trump took to Truth Social to directly express his thoughts.

"Where do these initial three Judges come from? How is it possible for them to have potentially done such damage to the United States of America? Is it purely a hatred of “TRUMP?” What other reason could it be?" wondered Trump who hypothesized that it might have something to do with The Federalist Society.

"The ruling by the U.S. Court of International Trade is so wrong, and so political! Hopefully, the Supreme Court will reverse this horrible, Country threatening decision, QUICKLY and DECISIVELY," Trump wrote. "Backroom “hustlers” must not be allowed to destroy our Nation!"

"The horrific decision stated that I would have to get the approval of Congress for these Tariffs," Trump complained. "In other words, hundreds of politicians would sit around D.C. for weeks, and even months, trying to come to a conclusion as to what to charge other Countries that are treating us unfairly."

"If allowed to stand, this would completely destroy Presidential Power — The Presidency would never be the same!" Trump charged.

The United States Court of International Trade just ruled that the Trump administration’s tariffs issued under the International Emergency Economic Powers Act (IEEPA) are invalid and cannot be implemented. The court ruled in favor of Connecticut Attorney General Tong and a coalition of 11 other attorneys general who sued the Trump administration in April for violating the law by imposing worldwide tariffs under IEEPA.

“The president’s lawless tariffs have inflicted chaos and pain on families here in Connecticut. This judgement completely halts these pointless, massive taxes forced upon American consumers and is a major victory for businesses and jobs here in Connecticut and across the country,” said Attorney General Tong.

The coalition sued the Trump administration for imposing tariffs under IEEPA through executive orders, social media posts, and agency orders, arguing that the president has no such power under IEEPA.

The United States Court of International Trade today ruled that the law does not authorize any of the tariffs imposed by the Trump administration under IEEPA, including tariffs on China, Mexico, Canada, and the European Union. The court found the tariffs to be unlawful and ordered that they be permanently blocked.

Joining Attorney General Tong in filing this lawsuit are the attorneys general of Arizona, Colorado, Delaware, Illinois, Maine, Minnesota, Nevada, New Mexico, New York, Oregon, and Vermont. 

White House Spokesperson Kush Desai put out a statement blaming "foreign countries' nonreciprocal treatment of the United States" for persistent trade deficits that have "created a national emergency that has decimated American communities, left our workeres behind and weakened our defense industrial base."

"It is not for unelected judges to decide how to properly address a national emergency," charged Desai. "President Trump pledged to put America First and the Administration is committed to using every lever of executive power power to address this crisis and restore American Greatness.”

The Trump administration can appeal the decision to the U.S. Supreme Court.

What an idiot. His "ruling" lasted less than 24 Hrs. The Court has ZERO Jurisdiction over the Executive Branch... strip him of his robes, and disbar this idiot.
