  • Democrats Call For Candidates’ ‘Litmus Test’ Of Support For Packing Supreme Court

    Democrats in high places are openly admitting to establishing a new “litmus test” for their candidates for public office: support packing the U.S. Supreme Court with justices who will create an immediate liberal majority and interpret the Constitution according to the wants of their party – or get “sacked.”

    Law professor and legal analyst Jonathan Turley has been further highlighting this trend this week, most recently citing U.S. Rep. Jim Clyburn’s (D-South Carolina) “bizarre” declaration Sunday during an interview with NBC’s Meet the Press that the Court must be expanded to 13 members to prevent black Americans from losing their constitutional rights.

    As Turley noted, when host Kristen Welker asked Clyburn if he backs the urging of Kamala Harris to pack the Court, he replied, “Yes, I do.”

    “I think that we are in a position now that calls for some significant actions taken by the Congress and we ought to expand,” the congressman explained. “Thirteen is a pretty good number. A baker’s dozen would be a good number to have on the Court. And I would hope we would get people on the Court who will follow the constitutional underpinnings of this great nation of ours.”

    But Clyburn went further, claiming that, if the Court is not packed with liberal Democrat justices, black Americans would likely return to a slave-era environment in the United States.

    “We have now a Supreme Court that has decided to reverse course and take this country back, I say, to those rulings of Justice Taney that said that no black man has any rights that a white man must respect,” Clyburn said.

    Turley observed the incongruity in Clyburn’s comment – perhaps one many see in the claim of Democrats that requiring a voter ID would exclude many black Americans from voting – as if black Americans would not be capable of determining how to present a voter ID at the polls.

    The New York Times best-selling author of Rage and the Republic: The Unfinished Story of the American Revolution – Turley wrote Clyburn’s claim is “deeply offensive to the justices” and suggests “contempt not just for the Court but for Black voters.”

    A day earlier, Turley observed that University of Pennsylvania Professor Michael Mann – the Vice Provost for Climate Science, Policy, and Action – is now pressing Democrat candidates to vow to support to pack the Court or get out of the race.

    “Mann joins a growing list of figures demanding the hostile takeover of the Court from Kamala Harris to Pete Buttigieg,” Turley wrote. “The priority is telling. Much of what is planned by the far-left will be difficult to accomplish due to constitutional limits. You can remove those limits by eliminating an independent Supreme Court and turning this essential institution into a federal version of state courts packed with partisan jurists.”

    The legal analyst continued that many more on the left – “including former Attorney General Eric Holder” – are openly admitting that partisanship is the only way to go.

    “In other words, it is time to make the Supreme Court itself partisan and political,” Turley warned. “It will then be reduced to just another partisan institution in an age of rage.”
