In a letter to James O’Keefe, president of Project Veritas, the Connecticut Office of the Attorney General has indicated that they “anticipate issuing subpoenas for relevant materials” related to an investigation of discriminatory employment practices in the Greenwich Public Schools.

Project Veritas first released a video on August 30th, in which Jeremy Boland, Assistant Principal of Cos Cob Elementary School, revealed that in his school they prefer not to hire candidates older than thirty or who are Catholics.

Now, the CT Attorney General has opened a civil rights investigation. And, is apparently using this investigation to harass journalists who are engaged in lawful and protected journalism by announcing subpoenas that are illegal.

Lawyers for Project Veritas have demanded the letter be immediately retracted, arguing that it violates the First Amendment, and is contrary to federal and state law.

As a journalistic enterprise, Project Veritas is protected by reporter’s Shield Laws that establish very specific provisions to demand and obtain material from journalists. Citing Connecticut’s own Shield Law (Section 52-146t of the Connecticut General Statues,) they argue that before issuing subpoenas, the Office of the Attorney General must provide evidence that “there are reasonable grounds to believe that a crime has occurred,” the information is “critical or necessary to the investigation,” the information is “not obtainable from any alternative source,” and “there is an overriding public interest in the disclosure.”

The Office of the AG asserted “the scope and nature of [their] investigation may evolve as it progresses.” We have an obvious threat that is not so ‘thinly veiled’ as characterized by Project Veritas in its response.
